Whereas the original purchaser (the, "Purchaser") has contracted with an independent, local homebuilder (the "Builder") to have a home constructed using building modules (the "Modules") manufactured by Cardinal Homes, Inc. ("Cardinal"), Cardinal warrants to the original Purchaser that such Modules will be free from substantial defects in materials and workmanship for a period of thirteen (13 months from the day Modules are set on Purchaser's foundation. Cardinal will repair or replace, in its sole discretion, any substantial defects in materials or workmanship occurring during this period.

SUCH REPAIR OR REPLACEMENT OF ANY SUCH SUBSTANTIAL DEFECTS IN MATERIALS OR WORKMANSHIP SHALL BE THE SOLE REMEDY AVAILABLE TO THE PURCHASER, AND THE PURCHASER SHALL BE ENTITLED TO NO FURTHER OR ADDITIONAL REMEDIES, HEREBY EXPRESSLY WAIVING ANY AND ALL OTHER CLAIMS FOR DAMAGES, WHETHER DIRECT OR INDIRECT, CONSEQUENTIAL OR INCIDENTAL, INCLUDING PROPERTY DAMAGE.

This warranty shall cease to be effective if the Modules shall have been altered without, Cardinal's express written consent or if the Modules have been abused, neglected, abandoned, or otherwise not cared for in a reasonable manner or used other than for residential purposes.
This warranty does not apply to work performed by, or products provided by, anyone other than Cardinal. This warranty does not apply to appliances (ranges, refrigerators, freezers, garbage disposals, dishwashers, water heaters, clothes washers and dryers, air conditioners, etc.), fixtures (plumbing, electrical, etc furniture, floor coverings, windows, doors, shingles and other similar products manufactured by others, nor does this warranty apply to damage to the Modules caused by others including without limitation, (a) damage occurring after delivery to the building site, (b) improper delivery to the purchaser, (c) improper set-up procedures, or (d) work performed after delivery if these functions are performed by anyone other than Cardinal.

THIS WARRANTY EXCLUDES ANY OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES ARISING IN CONNECTION WITH THE SALE OF MODULES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY FOR A PARTICULAR PURPOSE, AND IS LIMITED TO A PERIOD OF THIRTEEN MONTHS FROM DAY MODULES ARE SET INTO PURCHASER’S FOUNDATION.

No employee, Builder, agent, sub-contractor or other person is authorized by Cardinal to make, on Cardinal's behalf, any warranty or representation with respect to Modules, other than as expressly contained herein.

Cardinal reserves the right to make changes at any time in the design and specifications of its products without imposing on itself any liability to make corresponding changes to its products theretofore manufactured.

This warranty gives you specific legal rights, and you may also have other rights, which may vary from state to state.
If the Purchaser believes that the Modules contain defects covered by this warranty, Purchaser should notify Builder, giving sufficient information to enable Builder to resolve the matter. This is not to be construed as giving express written consent to Builder to make substantial alterations to the Modules. If Builder is unable or unwilling to resolve the problem and Purchaser is still convinced that it is covered by this warranty, the Purchaser should write to the Service Manager at Cardinal's factory (P.O. Box 10, Wylliesburg, VA 23976), providing complete information about the problem. Upon receipt of such information by Cardinal, if it appears that the problem is covered by this warranty and that Builder is unable or unwilling to resolve the problem, Cardinal will make arrangements with the Builder to investigate the claim, and if defect(s) is (are) covered, schedule repairs as soon as possible. Cardinal is not obligated by this warranty to perform service on work performed by Builder.

Note: Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on how long an implied warranty lasts, so above limitation or exclusions may not apply.
